These are the terms for the Human Bean loyalty card app and the stamp scheme behind it. They are short, because the app does one thing: it keeps your stamp card. Using the app means agreeing to them.
Who we are
The Human Bean app and the loyalty scheme are run by Lara Maritz, trading as Human Bean, of 34 High Trees Drive, BT21 0GQ, Northern Ireland. Your agreement is with us: the stamps, the free drinks and the coffee are the shop's. Write to us at humanbeanmcfaddens@gmail.com about anything on this page.
The app is built and run for us by Digitalhope Ltd, and listed on Google Play under its name. That does not make it a party to these terms.
Your account
- You need an account to hold a card. You can create one with Apple, with Google, or with an email address and a password.
- One account per person, and one card per account. The scheme is for customers, not for collecting on somebody else's behalf.
- Keep your sign-in to yourself. Anybody who can get into your account can spend your free drinks.
- You must be 13 or over to hold an account. The app is not aimed at children, and the privacy policy says the same.
- Give us an email address that reaches you. It is how we would tell you about a problem with your card.
How the scheme works
Buy a coffee, show the code in the app, and a member of staff scans it to put a stamp on your card. You buy nine, and the next one is on us.
- Stamps are added by the shop, not by you. Only a member of staff can add one, by scanning your code at the counter or typing in the short code beneath it.
- A round counts. Up to two stamps can go on in one visit, so buying two coffees together is one scan and two stamps.
- Nothing is lost when a card fills. Finishing a card starts a new one, and any stamps over the nine carry across to it.
- A full card and a free drink are not the same thing. When your card fills, the free drink becomes its own thing, waiting on your card until you use it. Your card starts again from empty.
- Free drinks expire 90 days after you earn them. The app tells you when one is waiting and warns you before it runs out.
- One free drink at a time. A free drink is a drink, not money off something else, and it cannot be swapped for cash or transferred to anybody else.
The app shows the current scheme, and the current scheme is the one that applies. The numbers above are what they are today.
The code you show at the counter
The code is single use and expires within a couple of minutes, which is what stops somebody collecting stamps from a photograph of your screen. Show it to a member of staff at the counter. Do not post it, send it on, or let somebody else use it — that is misuse of the scheme, and it is your card that pays for it.
Paying for your coffee
The app takes no payments and holds no card details. You pay the shop for your coffee in the usual way, and that sale is between you and the shop. The loyalty scheme sits alongside it.
When something goes wrong
If a stamp does not appear, or one goes on the wrong card, tell the shop or email us. We can see your history and put it right, including adding a stamp that was missed or taking off one that should not have gone on. Every correction is recorded.
If the app is down, the scheme is not. Keep your receipt and we will sort the stamp out afterwards.
Misuse
We may remove stamps or free drinks, suspend an account, or close one, if the scheme is being misused — for example sharing codes, collecting stamps without buying anything, or using more than one account. We will tell you why, and you can reply to us about it. We would always rather ask first.
To keep things fair we may also limit how many stamps can go on in a day, how soon after one stamp the next can go on, or require that the phone is at the shop. If we turn any of those on, the app will tell you when it stops you.
Changing or ending the scheme
The shop can change the scheme — how many stamps a free drink takes, how long one lasts, which drinks are included. If a change makes the scheme less generous, we will tell you in the app before it takes effect.
A free drink you have already earned stays yours, on the terms it was earned under, until you use it or it expires.
If we end the scheme altogether, we will give you at least 30 days' notice and time to use what you have earned.
The app itself
The app is free. It needs a reasonably recent iPhone or Android phone and an internet connection. We may change it, or stop supporting an old version of it, and we may have to take it offline from time to time. We do not promise it will always be available, and the things we cannot control — your phone, your signal, the app stores — are not something we can be responsible for.
Where we stand if something goes wrong
We are responsible to you for loss you suffer because we have broken these terms or have not used reasonable care and skill. We are not responsible for loss that was not foreseeable, or for anything caused by your own breach of these terms.
The scheme is a free extra, not something you have paid for, so what is at stake is the stamps and free drinks on your card. If we get that wrong, we will put the card right.
Nothing here limits your legal rights as a consumer, and nothing here limits our responsibility for death or personal injury caused by our negligence, or for fraud. If any part of these terms turns out not to be enforceable, the rest still stands.
Ending your account
You can delete your account at any time, in Profile, or through the account deletion page if you cannot get into the app. Any stamps and free drinks on it go with it, so use them first. What is kept afterwards, and what is removed, is set out in the privacy policy.
Your privacy
What we hold and why is in the privacy policy. The short version: your card, your history, and no tracking, no adverts, and no idea where you are.
Changes to these terms
When these terms change, the new version is published here and the date at the top changes with it. If a change affects the scheme or your account, we will tell you in the app before it takes effect.
Law
These terms are governed by the law of Northern Ireland, and the courts of Northern Ireland deal with any dispute. If you live elsewhere in the United Kingdom, you can bring a claim in your own country's courts instead.
